This Terms of Service (“Agreement”) is issued by the individual developer opaic (“we,” “us,” or “SwitchUp”) and governs your (“user” or “you”) use of SwitchUp’s services, including AI hairstyle generation, personalized hairstyle library, history and favorites management, subscription memberships, notifications, and related features. Please read this Agreement carefully before using the app. By accessing or continuing to use SwitchUp, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

If you do not agree to any part of this Agreement, stop using the app immediately.


1. Scope and Acceptance

  • This Agreement applies to all features and services provided within SwitchUp, including any future additions or adjustments.
  • This Agreement, together with the “SwitchUp Privacy Policy,” forms the complete agreement between you and us regarding your use of SwitchUp. If there is any inconsistency, the usage rules in this Agreement prevail, while the Privacy Policy governs data processing.
  • You may not transfer any rights or obligations under this Agreement without our prior written consent.

2. Account Eligibility

  • You must have full legal capacity to use SwitchUp. Minors should use the app only with guardian consent and guidance, and must obtain explicit guardian consent before submitting personal information or making payments.
  • We may reasonably limit the number of accounts, login devices, or feature access based on operational or risk-control needs.

3. Services

  • AI hairstyle generation and try-on: Upload/capture a front-facing photo, choose a reference style or input prompts, and generate new hairstyle images via cloud AI services.
  • Asset management and sync: Sync generated records, favorites, and downloads across local and cloud storage for history viewing and multi-device recovery.
  • Membership and subscriptions: In-app purchases through Apple App Store / Google Play to unlock premium features and credits.
  • Notifications and settings: Push/email notifications, privacy/general settings, theme and language options.
  • Support: Access support channels or submit feedback via “Help Center” or “About.”

4. Payments and Auto-Renewal

  • Subscriptions and in-app purchases are billed by Apple App Store / Google Play. Pricing, billing cycles, and promotions are subject to what the platforms display.
  • Auto-renewal:
    • Within 24 hours before expiration, the platform charges the current price and renews the next cycle unless you cancel auto-renew in advance.
    • You can disable auto-renewal in platform account settings (e.g., iOS “Settings > Apple ID > Subscriptions” or Android Play Store subscription management).
    • Once renewed, the current cycle is non-refundable. For refunds, follow each platform’s policies (including refund conditions, channels, and timelines).
  • We only obtain necessary transaction fields (e.g., order ID, receipt, validity) for verification. We do not store your bank account or full payment details.

5. User Conduct

  • You agree to use SwitchUp lawfully and refrain from any illegal, infringing, or improper behavior, including but not limited to:
    • Uploading, generating, or sharing illegal, infringing, pornographic, violent, discriminatory, or otherwise inappropriate content.
    • Using others’ portraits, works, trademarks, or other rights without authorization.
    • Interfering with, bypassing, or disrupting app security or fair use (e.g., scraping, bulk registrations, malicious refunds, API abuse, reverse engineering).
    • Using generated outputs for medical, cosmetic diagnosis, or other regulated scenarios requiring professional qualifications.
  • If you violate this section, we may immediately suspend or terminate services and cooperate with rights holders or regulators as required by law.

6. User Content and IP

  • You retain rights to the content you upload (photos, prompts, notes). To deliver hairstyle generation, history/favorites management, and service improvements, you grant us a non-exclusive, revocable, worldwide license during the service term, limited to providing or improving SwitchUp’s features for you.
  • AI-generated results are provided via third-party model services. Ownership and availability are subject to applicable law and model/platform policies. Within legal limits, you may reasonably use generated results but must ensure no infringement of third-party rights.
  • All IP rights in SwitchUp, including interfaces, features, algorithms, code, and marks, belong to us or relevant rights holders. Without written permission, you may not copy, modify, distribute, or create derivative works.

7. AI Outputs and Disclaimer

  • AI outputs are automatically generated based on your inputs and model characteristics. We do not guarantee accuracy, completeness, suitability, or fitness for any particular purpose.
  • Outputs may have style bias, recognition errors, or differ from real hairstyles. They are for reference only and not for medical, cosmetic, identity verification, or other professional uses.
  • You must review and use outputs prudently and bear all resulting responsibility. If you violate laws, infringe third-party rights, or misuse outputs leading to disputes, you are solely responsible.

8. Data and Privacy

Please review and agree to the “SwitchUp Privacy Policy” to understand how we collect, use, store, and protect your personal information and your rights. We use Firebase for crash collection and process/store related data in servers and hosting environments located in the United States. If future processing involves other regions or special terms, we will explain in the Privacy Policy or this Agreement.

9. Minors

SwitchUp is intended for adults. Users under 18 must obtain guardian consent and guidance and get explicit consent before submitting personal information, uploading photos, or making payments. If we discover unauthorized minor use, we may suspend services or delete related information.

10. Service Changes, Suspension, and Termination

  • We may adjust, suspend, or terminate services for operational, security, or legal reasons and will use reasonable efforts to notify you in advance. For paid entitlements, we will follow platform policies for handling.
  • If you violate this Agreement or applicable laws, we may suspend or terminate some or all services without prior notice.

11. Limitation of Liability

  • To the maximum extent permitted by law, SwitchUp is provided “as is” and “as available.” We make no express or implied warranties regarding accuracy, stability, freedom from errors, or fitness for your particular needs.
  • For interruptions or data loss due to force majeure, third-party service failures, network or device issues, or changes in platform billing rules, we will provide reasonable assistance but are not liable beyond mandatory legal requirements.

12. Governing Law and Dispute Resolution

  • This Agreement is governed by and construed under the laws of the United States. If local mandatory laws apply, those provisions prevail.
  • Disputes arising from this Agreement or SwitchUp services should first be resolved through friendly consultation. If unresolved, they shall be submitted to the competent courts in the State of California, USA.

13. Updates and Notice

  • We may update this Agreement due to business, legal, or regulatory needs. Material changes will be communicated via in-app pop-ups, messages, or website notices, and explicit consent will be obtained when required.
  • Continued use after changes take effect constitutes acceptance of the updated terms.
